AYAT RAJAM YANG DINASAKH TAPI HUKUM TETAP BERLAKU


Bahwa nasikh-mansukh itu memang ada dalam Islam, hal ini diperkuat oleh firman Allah Ta'ala sendiri :

(QS 2:106) Ayat mana saja yang Kami nasakhkan, atau Kami jadikan lupa kepadanya, Kami datangkan yang lebih baik daripadanya atau yang sebanding dengannya. Tidakkah kamu mengetahui bahwa sesungguhnya Allah Maha Kuasa atas segala sesuatu?

Ada 3 macam nasakh yang dikenal dalam dunia ilmu ushul fiqih:
1. Ayat Al-Qur'an yang dinasakh lafadznya dan hukumnya sekaligus.
2. Ayat Al-Qur'an yang dinasakh lafadznya tapi hukumnya tetap berlaku.
3. Ayat Al-Qur'an yang dinasakh hukumnya tapi lafadznya tetap masih ada

2. Ayat Al-Qur'an yang dinasakh lafadznya tapi hukumnya tetap berlaku.
Contohnya adalah hukuman rajam bagi pezina muhsan, dan lafadznya adalah sebagai berikut :
    Asy-Syaku wasy-syaikhatu idzaa zanaya farjumuhumal battah nakaalan minallah wallahu 'azizun hakim

    “Laki-laki yang sudah menikah dan perempuan yang sudah menikah bila mereka berzina, maka rajamlah mereka berdua, sebagai hukuman dari Allah dan Allah Maha Perkasa lagi Maha Bijaksana”.


1. Umar bin Khaththab ra. ketika menjabat sebagai Khalifah berkata, "Demi Allah, ayat ini pernah turun ke muka bumi, lalu kemudian Allah SWT menasakh lafadznya namun hukumnya tetap berlaku."
2. Ubay bin Ka'ab ra. dimana beliau menyebutkan bahwa ayat ini dulunya terdapat di dalam surat Al-Ahzab. Dan menurut beliau, sebelum sebagian ayatnya dihapuskan, surat Al-Ahzab sangat panjang seperti surat Al-Baqarah. (Dalam HR. Ibnu Majah dalam kitab shahihnya).

HR Bukhari, Muslim, Abu Daud, Tirmizy dan An-Nasai :
Dari Ibnu Abbas ra. bahwa Umar bin al-Khaththab berkhutbah, "Sesungguhnya Allah SWT mengutus nabi Muhammad saw. dengan haq dan juga menurunkan kepadanya Al-Kitab (Al-Qur'an). Dan diantara ayat yang turun kepadanya adalah ayat rajam (“Laki-laki yang sudah menikah dan perempuan yang sudah menikah bila mereka berzina, maka rajamlah mereka berdua, sebagai hukuman dari Allah dan Allah Maha Perkasa lagi Maha Bijaksana.”). Kami telah membacanya dan memahaminya. Dan Rasulullah telah merajam dan kami pun juga telah merajam. Sungguh aku khawatir setelah masa yang panjang nanti akan ada seorang yang berkata, "Kita tidak mendapati keterangan tentang rajam di dalam Qur'an." Maka orang itu telah menyesatkan dengan meninggalkan faridhah (kewajiban) yang telah Allah turunkan. Hukum rajam adalah benar bagi pezina baik laki-laki maupun perempuan yang muhshan, yaitu bila telah ditegakkan bayyinah (saksi) atau pengakuan. Demi Allah, jangan sampai ada orang yang mengatakan bahwa Umar telah menambahi ayat Al-Qur'an.

Sahih Muslim, Book 017, Hadith Number 4194. Chapter : Stoning of a married adulterer.
'Abdullah b. 'Abbas reported that 'Umar b. Khattab sat on the pulpit of Allah's Messenger (may peace be upon him) and said: Verily Allah sent Muhammad (may peace be upon him) with truth and He sent down the Book upon him, and the verse of stoning was included in what was sent down to him. We recited it, retained it in our memory and understood it. Allah's Messenger (may peace be upon him) awarded the punishment of stoning to death (to the married adulterer and adulteress) and, after him, we also awarded the punishment of stoning, I am afraid that with the lapse of time, the people (may forget it) and may say: We do not find the punishment of stoning in the Book of Allah, and thus go astray by abandoning this duty prescribed by Allah. Stoning is a duty laid down in Allah's Book for married men and women who commit adultery when proof is established, or it there is pregnancy, or a confession.

Sahih Bukhari, Volume 8, Book 82, Number 816:
Narrated Ibn 'Abbas:
'Umar berkata, "Aku khawatir jika waktu lama telah berlalu, orang2 akan berkata, "Kami tidak menemukan ayat2 Rajam (dilempari batu sampai mati) dalam Al-Qur'an, " dan maka mereka jadi tidak melakukan kewajiban yang telah Allah tetapkan. Perhatikan! Aku menegaskan bahwa hukum Rajam harus dilaksanakan bagi dia yang melakukan hubungan seks haram, jika dia telah menikah dan kejahatan ini dibuktikan oleh saksi2 atau kehamilan atau pengakuan." Sufyan menambahkan, "Aku telah mengingatnya seperti ini." 'Umar menambahkan, "Sudah jelas bahwa Rasul Allah melakukan hukum Rajam, dan jadi kami pun harus mengikuti perbuatannya." HR Muttafaq 'alaih :
"Tidak halal darah seorang muslim kecuali karena salah satu dari tiga hal: orang yang berzina, orang yang membunuh dan orang yang murtad dan keluar dari jamaah.'



Adapun jika seseorang telah bertaubat, lalu mendatangi penguasa Islam yang menegakkan had dan mengaku berbuat zina, serta memilih ditegakkan had padanya, maka had boleh ditegakkan (walaupun tidak wajib), Jika tidak, maka tidak ditegakkan. Karena NABI BERSIKAP BERUSAHA AGAR RAJAM TDK TERJADI. [Majmu Fatawa 16/31]

Bila Sudah Bertaubat Dari Zina Apakah Tetap Harus Dirajam?
Jika seseorang sudah bertaubat dari zina (atau pencurian, minum khamer, dan lainnya) dan urusannya belum sampai kepada penguasa Islam yang menegakkan syari’at, maka had zina (cambuk atau rajam) gugur dari orang yang bertaubat tersebut. Hal ini dengan dalil-dalil sebagai berikut, firman Allah Subhanahu wa Ta’ala.

[An-Nisaa : 16] “Dan terhadap dua orang yang melakukan perbuatan keji diantara kamu, maka berilah hukuman kepada keduanya. Kemudian jika keduanya bertubat dan memperbaiki diri, maka biarkanlah mereka. Sesungguhnya Allah Maha Penerima taubat lagi Maha Penyayang”

[Al-Maidah : 39] “Maka barangsiapa bertaubat (diantara pencuri-pencuri itu) sesudah melakukan kejahatan itu dan memperbaiki diri, maka sesungguhnya Allah menerima taubatnya. Sesungguhnya Allah Maha Pengampun lagi Maha Penyayang”.

Hadits Riwayat Ibnu Majah No. 4250 dan lainnya,
Dari Abdullah bin Mas’ud : Sabda Rasulullah Shallallahu ‘alaihi wa sallam.
“Artinya : Orang yang bertaubat dari semua dosa seperti orang yang tidak memiliki dosa” []

Hadits Riwayat Muslim dan lainnya:
Hadits dari Nu’aim bin Hazzal : “Ma’iz bin Malik adalah seorang yatim dibawah asuhan bapakku. Lalu dia menzinahi seorang budak dari suku itu. Maka bapakku berkata kepadanya, “Pergilah kepada Rasulullah Shallallahu ‘alaihi wa sallam, lalu beritahukan kepada beliau apa yang telah engkau lakukan. Semoga beliau memohonkan ampun untukmu”.Bapakku menghendaki hal itu karena berharap Ma’iz memperoleh solusi. Maka Ma’iz mendatangi beliau dan berkata, “Wahai Rasulullah sesungguhnya aku telah berzina. Maka tegakkanlah kitab Allah atasku”. Lalu beliau berpaling darinya. Kemudian Ma’iz mengulangi dan berkata, ““Wahai Rasulullah sesungguhnya aku telah berzina. Maka tegakkanlah kitab Allah atasku”. Maka beliau berpaling darinya. Kemudian Ma’iz mengulangi dan berkata, ““Wahai Rasulullah sesungguhnya aku telah berzina. Maka tegakkanlah kitab Allah atasku”. Sampai dia mengulanginya empat kali. Rasulullah Shallallahu ‘alaihi wa sallam bersabda, “Engkau telah mengatakannya empat kali. Lalu dengan siapa ?. Dia menjawab, “Dengan si Fulanah”. Lalu beliau bersabda, “Apakah engkau berbaring dengannya?”. Dia menjawab, “Ya”. Lalu beliau bersabda, “apakah engkau menyentuh kulitnya?”. Dia menjawab, “Ya”. Lalu beliau bersabda, “Apakah engkau bersetubuh dengannya?”. Dia menjawab, “Ya”.Maka beliau memerintahkan untuk merajamnya. Kemudian dia dibawa keluar ke Harrah [Nama tempat di luar kota Madinah]. Tatkala dia dirajam, lalu merasakan lemparan batu. Dia berkeluh kesah, lalu dia keluar dan berlari. Maka Abdullah bin Unais menyusulnya. Sedangkan sahabat-sahabatnya yang lain telah lelah. Kemudian Abdullah mengambil tulang betis unta, lalu melemparkannya, sehingga dia membunuhnya. Lalu dia mendatangi Rasulullah Shallallahu ‘alaihi wa sallam dan menceritakanya kepada beliau. Maka beliau bersabda, “Tidakkah kamu membiarkannya, kemungkinan dia bertaubat, lalu Allah menerima tuabatnya!?”


Dalam hadits berikut dikisahkan pengakuan seorang pezina lelaki yg sudah nikah diacuhkan oleh nabi sampai 2 x namun pezina tsb memaksa.

Sunan Abu Dawud, Book 38, Number 4421:
Dikisahkan oleh Al-Lajlaj al-Amiri:
Aku sedang bekerja di pasar. Seorang wanita berlalu membawa seorang anak. Orang2 lalu segera mendekatinya, dan aku pun mengikuti mereka. Aku lalu pergi menghadap sang Nabi ketika dia bertanya: Siapakah ayah anak yang bersamamu ini? Wanita itu tetap diam. Seorang pria muda yang berada di sebelah wanita itu berkata: Akulah ayah anak ini, Rasul Allah! Sang Nabi lalu berpaling pada wanita itu dan bertanya: Siapakah ayah anak yang bersamamu ini? Pria muda itu berkata: Akulah ayahnya, Rasul Allah! Rasul Allah memandangnya lalu melihat kepada orang2 di sekitar pemuda itu dan menanyakan pada mereka tentang dirinya. Mereka berkata: Kami hanya tahu hal2 yang baik tentang dia. Sang Nabi berkata pada pemuda itu: Apakah kau menikah? Pemuda itu menjawab: Ya. Maka sang Nabi memberi perintah atas dirinya dan dia pun dirajam sampai mati. Dia (penyampai cerita) berkata: Kami membawa pemuda itu ke luar, menggali lubang baginya, dan memasukkan dia ke dalamnya. Kami melempari dia dengan batu sampai dia mati. Seorang pria lalu menanyakan tentang pemuda yang baru saja dirajam mati itu. Kami bawa orang itu kepada sang Nabi dan berkata: Orang ini datang bertanya tentang pemuda berdosa itu. Rasul Allah berkata: Dia lebih berkenan daripada wangi parfum di mata Allah. Pria ini adalah ayah pemuda tersebut. Kami lalu menolong dia membasuh, mengafani, dan menguburkan dia. (Penyampai cerita berkata:) Aku tidak tahu apakah dia berkata atau tidak berkata "sembahyang baginya." Ini adalah kisah dari Abdah yang lebih lengkap.

[color=blue]Dalam hadits berikut dikisahkan pengakuan seorang pezina laki2 (Ma’iz) dan perempuan (woman from ghamin) keduanya diacuhkan pengakuannya sampai 4 x namun pezina tsb memaksa ingin dirajam.


Sahih Muslim, Book 017, Hadith Number 4206.


'Abdullah b. Buraida reported on the authority of his father that Ma'iz b. Malik al-Aslami came to Allah's Messenger (may peace be upon him) and said: Allah's Messenger, I have wronged myself ; I have committed adultery and I earnestly desire that you should purify me. He turned him away. On the following day, he (Ma'iz) again came to him and said: Allah's Messenger, I have committed adultery. Allah's Messenger (may peace be upon him) turned him away for the second time, and sent him to his people saying: Do you know if there is anything wrong with his mind. They denied of any such thing in him and said: We do not know him but as a wise good man among us, so far as we can judge. He (Ma'iz) came for the third time, and he (the Holy Prophet) sent him as he had done before. He asked about him and they informed him that there was nothing wrong with him or with his mind. When it was the fourth time, a ditch was dug for him and he (the Holy Prophet) pronounced judgment about him.
He (the narrator) said: There came to him (the Holy Prophet) a woman from Ghamid and said: Allah's Messenger, I have committed adultery, so purify me. He (the Holy Prophet) turned her away. On the following day she said: Allah's Messenger, Why do you turn me away? Perhaps, you turn me away as you turned away Ma'iz. By Allah, I have become pregnant. He said: Well, if you insist upon it, then go away until you give birth to (the child). When she was delivered she came with the child (wrapped) in a rag and said: Here is the child whom I have given birth to. He said: Go away and suckle him until you wean him. When she had weaned him, she came to him (the Holy Prophet) with the child who was holding a piece of bread in his hand. She said: Allah's Apostle, here is he as I have weaned him and he eats food. He (the Holy Prophet) entrusted the child to one of the Muslims and then pronounced punishment. And she was put in a ditch up to her chest and he commanded people and they stoned her. Khalid b Walid came forward with a stone which he flung at her head and there spurted blood on the face of Khalid and so he abused her. Allah's Apostle (may peace be upon him) heard his (Khalid's) curse that he had hurried upon her. Thereupon he (the Holy Prophet) said: Khalid, be gentle. By Him in Whose Hand is my life, she has made such a repentance that even if a wrongful tax-collector were to repent, he would have been forgiven. Then giving command regarding her, he prayed over her and she was buried.

Sahih Muslim, Book 017, Hadith Number 4205.
Chapter : He who confesses his guilt of adultery.
Sulaiman b. Buraida reported on the authority of his father that Ma,iz b. Malik came to Allah's Apostle (may peace be upon him) and said to him: Messenger of Allah, purify me, whereupon he said: Woe be upon you, go back, ask forgiveness of Allah and turn to Him in repentance. He (the narrator) said that he went back not far, then came and said: Allah's Messenger, purify me. whereupon Allah's Messenger (may peace be upon him) said: Woe be upon you, go back and ask forgiveness of Allah and turn to Him in repentance. He (the narrator) said that he went back not far, when he came and said: Allah's Messenger, purify me. Allah's Apostle (may peace be upon him) said as he had said before. When it was the fourth time, Allah's Messenger (may, peace be upon him) said: From what am I to purify you? He said: From adultery, Allah's Messenger (may peace be upon him) asked if he had been mad. He was informed that he was not mad. He said: Has he drunk wine? A person stood up and smelt his breath but noticed no smell of wine. Thereupon Allah's Messenger (may peace be upon him) said: Have you committed adultery? He said: Yes. He made pronouncement about him and he was stoned to death. The people had been (divided) into two groups about him (Ma'iz). One of them said: He has been undone for his sins had encompassed him, whereas another said: There is no repentance more excellent than the repentance of Ma'iz, for he came to Allah's Apostle (may peace be upon him) and placing his hand in his (in the Holy Prophet's) hand said: Kill me with stones. (This controversy about Ma'iz) remained for two or three days. Then came Allah's Messenger (may peace be upon him) to them (his Companions) as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Ma'iz b. Malik. They said: May Allah forgive Ma'iz b. Malik. Thereupon Allah's Messenger (may peace be upon him) said: He (Ma'iz) has made such a repentance that if that were to be divided among a people, it would have been enough for all of them.
He (the narrator) said: Then a woman of Ghamid, a branch of Azd, came to him and said: Messenger of Allah, purify me, whereupon he said: Woe be upon you ; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Ma'iz. b. Malik. He (the Holy, Prophet) said: What has happened to you? She said that she had become pregnant as a result of fornication. He (the Holy Prophet) said: Is it you (who has done that)? She said: Yes. He (the Holy Prophet) said to her: (You will not be punished) until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered (of the child). He (that Ansari) came to Allah's Apostle (may peace be upon him) and said the woman of Ghamid has given birth to a child. He (the Holy Prophet) said: In that case we shall not stone her and so leave her infant with none to suckle him. One of the Ansar got up and said: Allah's Apostle, let the responsibility of his suckling be upon me. She was then stoned to death.


Dalam hadits berikut dikisahkan pengakuan seorang pezina laki2 (dari bani Aslam) diacuhkan pengakuannya sampai 4 x namun pezina tsb memaksa ingin dirajam.
Sahih Bukhari, Volumn 007, Book 063, Hadith Number 196.
Narated By Abu Huraira : A man from Bani Aslam came to Allah's Apostle while he was in the mosque and called (the Prophet) saying, "O Allah's Apostle! I have committed illegal sexual intercourse." On that the Prophet turned his face from him to the other side, whereupon the man moved to the side towards which the Prophet had turned his face, and said, "O Allah's Apostle! I have committed illegal sexual intercourse." The Prophet turned his face (from him) to the other side whereupon the man moved to the side towards which the Prophet had turned his face, and repeated his statement. The Prophet turned his face (from him) to the other side again. The man moved again (and repeated his statement) for the fourth time. So when the man had given witness four times against himself, the Prophet called him and said, "Are you insane?" He replied, "No." The Prophet then said (to his companions), "Go and stone him to death." The man was a married one. Jabir bin 'Abdullah Al-Ansari said: I was one of those who stoned him. We stoned him at the Musalla ('Id praying place) in Medina. When the stones hit him with their sharp edges, he fled, but we caught him at Al-Harra and stoned him till he died.

Sahih Muslim, Book 017, Hadith Number 4202.
Chapter : He who confesses his guilt of adultery.
Abu Sa'id reported that a person belonging to the clan of Aslam, who was called Ma,iz b. Malik, came to Allah's Messenger (may peace be upon him) and said: I have committed immorality (adultery), so inflict punishment upon me. Allah's Apostle (may peace be upon him) turned him away again and again. He then asked his people (about the state of his mind). They said: We do not know of any ailment of his except that he has committed something about which he thinks that he would not be able to relieve himself of its burden but with the Hadd being imposed upon him. He (Ma'iz) came back to Allah's Apostle (may peace be upon him) and he commanded us to stone him. We took him to the Baqi' al-Gharqad (the graveyard of Medina). We neither tied him nor dug any ditch for him. We attacked him with bones, with clods and pebbles. He ran away and we ran after him until he came upon the stone ground (al-Harra) and stopped there and we stoned him with heavy stones of the Harra until he became motionless (lie died). He (the Holy Prophet) then addressed (us) in the evening saying Whenever we set forth on an expedition in the cause of Allah, some one of those connected with us shrieked (under the pressure of sexual lust) as the bleating of a male goat. It is essential that if a person having committed such a deed is brought to me, I should punish him. He neither begged forgiveness for him nor cursed him.



100 tahun tdk ada lagi kualitas generasi sahabat.


Sahih Muslim, Book 031, Hadith Number 6160.

Chapter : Meaning of the saying of the Prophet (may peace be upon him): "No person would survive after a century who is living by this time of mine".
'Abdullah b. Umar reported that Allah's Messenger (may peace be upon him) led us 'Isha prayer at the latter part of the night and when he had concluded it by salutations he stood up and said: Have you seen this night of yours? At the end of one hundred years after this none would survive on the surface of the earth (from amount my Companions). Ibn Umar said: People were (not understanding) these words of the Messenger of Allah (may peace be upon him) which had been uttered pertaining to one hundred years. Allah's Messenger (may peace be upon him) in fact meant (by these words) that on that day none from amongst those who had been living upon the earth (from amongst his Companions) would survive (after one hundred years) and that would be the end of this generation.


KEHAMILAN BUKAN BUKTI UNTUK DIRAJAM KARENA DI ZAMAN NABI ADA KASUS BERZINA DAN HAMIL TDK DIRAJAM KARENA PEZINA MENOLAK DIRAJAM DGN MENYAMARKAN KEHAMILANNYA ATAS SUAMINYA.

seorang istri berselingkuh dan hamil dgn bayi mirip selingkuhannyam karena wanita tsb tdk ingin dirajam dia melakukan Lian (melaknat diri jika bohong). Wanita tsb lolos dari rajam karena lian dan kehamilannya disamarkan sbg benih suaminya. Kemudian suaminya menceraikan istrinya yg selingkuh shg menjadi tradisi jika LIAN terjadi maka suami istri CERAI.

Sahih BUkhari, Volumn 007, Book 063, Hadith Number 229.
Narated By Ibn Juraij : Ibn Shihab informed me of Lian and the tradition related to it, referring to the narration of Sahl bin Sad, the brother of Bani Sa'idi He said, "An Ansari man came to Allah's Apostle and said, 'O Allah's Apostle! If a man saw another man with his wife, should he kill him, or what should he do?' So Allah revealed concerning his affair what is mentioned in the Holy Qur'an about the affair of those involved in a case of Lian. The Prophet said, 'Allah has given His verdict regarding you and your wife.' So they carried out Lian in the mosque while I was present there. When they had finished, the man said, "O Allah's Apostle! If I should now keep her with me as a wife then I have told a lie about her. Then he divorced her thrice before Allah's Apostle ordered him, when they had finished the Lian process. So he divorced her in front of the Prophet." Ibn Shihab added, "After their case, it became a tradition that a couple involved in a case of Lian should be separated by divorce. That lady was pregnant then, and later on her son was called by his mother's name. The tradition concerning their inheritance was that she would be his heir and he would inherit of her property the share Allah had prescribed for him." Ibn Shihab said that Sahl bin Sad As'Saidi said that the Prophet said (in the above narration), "If that lady delivers a small red child like a lizard, then the lady has spoken the truth and the man was a liar, but if she delivers a child with black eyes and huge lips, then her husband has spoken the truth." Then she delivered it in the shape one would dislike (as it proved her guilty).

Sahih Bukhari, Volumn 007, Book 063, Hadith Number 230.
Narated By Al-Qasim bin Muhammad : Ibn 'Abbas; said, "Once Lian was mentioned before the Prophet whereupon 'Asim bin Adi said something and went away. Then a man from his tribe came to him, complaining that he had found a man width his wife. 'Asim said, 'I have not been put to task except for my statement (about Lian).' 'Asim took the man to the Prophet and the man told him of the state in which he had found his wife. The man was pale, thin, and of lank hair, while the other man whom he claimed he had seen with his wife, was brown, fat and had much flesh on his calves. The Prophet invoked, saying, 'O Allah! Reveal the truth.' So that lady delivered a child resembling the man whom her husband had mentioned he had found her with. The Prophet then made them carry out Lian." Then a man from that gathering asked Ibn 'Abbas, "Was she the same lady regarding which the Prophet had said, 'If I were to stone to death someone without witness, I would have stoned this lady'?" Ibn 'Abbas said, "No, that was another lady who, though being a Muslim, used to arouse suspicion by her outright misbehaviour."

Tindak perkosaan pernah terjadi pada masa Nabi Muhammad Saw, dan Pemerkosa dihukum Rajam sedangkan Korban tidak dihukum.

HR. Imam Turmudzi dan Abu Dawud, (lihat Ibn al-Atsir, Jâmi’ al-Ushûl, IV/270, no. hadits: 1823) :
dari sahabat Wail bin Hujr ra : “Suatu hari, ada seorang perempuan pada masa Nabi Saw yang keluar rumah hendak melakukan shalat di masjid. Di tengah jalan, ia dijumpai seorang laki-laki yang menggodanya, dan memaksanya (dibawa ke suatu tempat) untuk berhubungan intim. Si perempuan menjerit, dan ketika selesai memperkosa, si laki-laki lari. Kemudian lewat beberapa orang Muhajirin, ia mengarahkan: “Lelaki itu telah memperkosa saya”. Mereka mengejar dan menangkap laki-laki tersebut yang diduga telah memperkosanya. Ketika dihadapkan kepada perempuan tersebut, ia berkata: “Ya, ini orangnya”. Mereka dihadapkan kepada Rasulullah Saw. Ketika hendak dihukum, si laki-laki berkata: “Ya Rasul, saya yang melakukannya”. Rasul berkata kepada perempuan: “Pergilah, Allah telah mengampuni kamu”. Lalu kepada laki-laki tersebut Nabi menyatakan suatu perkataan baik (apresiatif terhadap pengakuannya) dan memerintahkan: “Rajamlah”. Kemudian berkata: “Sesungguhnya ia telah bertaubat, yang kalau saja taubat itu dilakukan seluruh pendudukan Madinah, niscaya akan diterima”.

Narated By Wa'il ibn Hujr : When a woman went out in the time of the Prophet (pbuh) for prayer, a man attacked her and overpowered (raped) her. She shouted and he went off, and when a man came by, she said: That (man) did such and such to me. And when a company of the Emigrants came by, she said: That man did such and such to me. They went and seized the man whom they thought had had intercourse with her and brought him to her. She said: Yes, this is he. Then they brought him to the Apostle of Allah (pbuh). When he (the Prophet) was about to pass sentence, the man who (actually) had assaulted her stood up and said: Apostle of Allah, I am the man who did it to her. He (the Prophet) said to her: Go away, for Allah has forgiven you. But he told the man some good words (AbuDawud said: meaning the man who was seized), and of the man who had had intercourse with her, he said: Stone him to death. He also said: He has repented to such an extent that if the people of Medina had repented similarly, it would have been accepted from them.

Hadits Riwayat Imam at-Turmudzi :
Ada seorang perempuan yang diperkosa pada masa Rasulullah Saw, maka ia dilepaskan dari ancaman hukuman perzinahan, sementara pelakunya dikenakan hukuman had”.

Dalam riwayat Imam Bukhari dan Malik (lihat Ibn al-Atsir, Jâmi’ al-Ushûl, IV/269, no. hadits:1822) :
Dari Nafi’ mawla Ibn ‘Umar ra, berkata: “Bahwa Shafiyyah bin Abi Ubaid mengkhabarkan: “Bahwa seorang budak laki-laki berjumpa dengan seorang budak perempuan, dan memaksanya berhubungan intim, maka Khalifah ‘Umar menghukumnya dengan cambukan, dan tidak menghukum si perempuan”..
